This website is operated by MathTech Thinking Foundation. Throughout the site, the terms “MTTF” “we”, “us” and “our” refer to MathTech Thinking Foundation, including its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors and employees. MathTech Thinking Foundation offers this website to all the users subject to knowledge of services and acceptance and confirmation to all terms, conditions, policies and notices stated here regarding online payment for the proposed services being provided by MTTF.
By authorizing a payment to MTTF through online payment system/ service (“the service”), it would be treated as an acceptance to all the terms and conditions including policies, notices, instructions and/ or following conditions or available by hyperlink as stated on this website and further an agreement to be bound by said terms and conditions. Therefore, the user is required to read these Terms of Service carefully before accessing or using our website. Continued use of the website constitutes user’s binding acceptance of these terms and conditions, including any changes or modifications made by MTTF.
The term ‘User’, “you”, “your”, “he”/ ‘she” “his”/ “her”, “customer”, “client’ “student”, “payer” related to the User refers to each and every person using this site / website/ portal/ service for online payment to MTTF.
MTTF reserves all the rights to amend these terms and conditions at any time without giving prior notice. Hence, it is the responsibility of the User to have read the terms and conditions before using the Service.
By agreeing to these Terms of Service, the user represents that he/she is at least the age of majority and has given his/her consent to allow any of his/her minor dependents to use this site.
ONLINE PAYMENT SYSTEM AND PROCESS
Online Payment system’s purpose is to provide flexibility and conform to its continuing users by offering option to pay online using various modes of payment. Necessary information and instructions regarding procedure of online payment like option of payment, procedure of payment, status of payment (successful/ failed) are given in login page, hence read and follow the instructions carefully, such as;
1. Login on the MTTF’s portal through the website for making any kind of payment to MTTF.
2. There is a payment gateway to choose the mode of payment (Net-banking/ Credit/ Debit card).
3. Enter Net-banking/ Credit/ Debit card details and follow the mandatory procedure.
4. Payment will be authenticated over the gateway and concerned account of payer will be instantly debited.
5. An acknowledgement of confirmation against payment is generated instantly with Transaction Reference Number, on following the given procedure of payment.
In case no response is received after providing the details of authorization (debit or credit card or net banking) for payment and debiting of concerned account, check with credit card company/ bank before contacting the Institute. However, for any kind of genuine enquiry, user may contact at head.acct@mttf.in
KEY TERMS
These terms and conditions apply to the User who uses the Online Services provided for any payment made to MTTF. Please read the terms and conditions carefully. You will be deemed to have accepted these terms and conditions by authorizing a payment through the online payment system.
1. Payment – Payment(s) may only be made with permissible and approved sources like Credit Card, Debit card or Net Banking.
2. Provision of information by the User – The user shall have no objection, whatsoever, for providing required details to the Online Payment System of MTTF. User should exercise caution when deciding to disclose or key-in personal information on-line and ensure that no third party is able to access such personal information as user only keys it in or views it on the screen of concerned computer. It is the sole responsibility of the User to ensure that the information entered in the relevant fields is correct. The user further agrees and undertakes to provide correct and valid information/ details. It is recommended that User take and retain a copy of the transaction for record keeping purposes.
3. Rejection/ Reversal/ Refusal of payment – The user shall have no objection if Online Payment System rejects the payment amount because of incorrect or incomplete entries or for any other reason. MTTF accepts no responsibility for the matter of refusal or reversal of payments which is concerned with service user credit card provider/ bank.
4. Cancellation / Refund – The user shall have not right to cancel the transaction of payment once made by the user. However, matter of refund and cancellation of payment may be considered as per Refund & Cancellation Policy.
5. Privacy – Privacy shall be maintained as per Privacy Policy.
6. Cookies – Cookies are computer data storage programs which enable a web site to record a visitor’s activities from his/ her computer hard drive. A cookie is placed on server for as long as a session is active. No data from the user’s computer is accessed from our site. Our cookies tag each visitor’s browser with a random, unique number. The cookie simply assigns a number and does not disclose any personal information about the person using the browser.
7. Intellectual Property Rights – User may not insert a hyperlink to this website or any part thereof on any other website or mirror or frame this website, any part thereof or any information or materials contained in this website on any other server, website or web-page.
8. Hyperlinks to other resources – Hyperlinks to other internet resources are for the user’s convenience only and are at risk of user. The content, accuracy, legality of or restrictions imposed or opinions expressed by and other links provided by or for these resources are not investigated, verified, monitored, nor endorsed by MTTF. MTTF is not responsible either for their standards of public order and decency or for their personal data protection policy or the use that could be made of such data. When user accesses another website through a hypertext link, user is accepting that this access is at user’s own risk. Consequently, MTTF will not be liable for any loss or damage arising directly or indirectly from the accuracy or otherwise of materials or information contained on the pages of such sites or for any loss arising directly or indirectly from the defects with such sites.
9. Security – The details of payment submitted through this payment gateway are encrypted. The site is secured to offer secured communications by encrypting all data to and from the site. Information submitted by user to MTTF via MTTF web site and pages thereon shall be deemed to be the property of MTTF. However, MTTF does not assure that information, provided online by a user, may not be able to be read or intercepted by any third party. The user agrees, understands and confirms that his/ her personal data transmitted over the internet may be susceptible to misuse; hacking, theft and/ or fraud and that MTTF have no control over such matters. Therefore, MTTF does not warrant any liability in the event of the interception, “hacking” or other unauthorized access to information provided by the user of this service. MTTF, further, shall not be liable for any failure of user making payment to protect properly from others, processor in respect of any omission to provide accurate information in the Course of usage of site.
10. Prohibitions – In addition to other prohibitions, if any, as set forth in the Terms of Service, you while using the site or its content, are prohibited:
a. to se for any unlawful purpose;
b. to solicit others to perform or participate in any unlawful acts;
c. to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
d. to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
e. to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;

m. to insert a hyperlink to this website or any part thereof on any other website or mirror or frame this website, any part thereof or any information or materials contained in this website on any other server, website or web-page. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
11. Transmission & Breach – The user must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the terms will result in necessary legal proceedings accordingly.

Claim of user – The User agrees that he will not hold MTTF liable for any loss or damages arising from his/ her use of, or reliance upon the information contained on the Website, or any failure to comply with these Terms and Conditions where such failure is due to circumstances beyond reasonable control.
13. Disclaimer of warranties & limitation of liability – MTTF gives no warranty, representation or guarantee, express or implied, in respect of the operation of the service. We do not guarantee, represent or warrant that your use of our service or its result will be uninterrupted, timely, secure or error-free, trouble free, regular, accurate or reliable. We undertake no obligation to update, amend or clarify information in the service or on any related website, including without limitation, except as required by law. No specified update or refresh date applied in the service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated. MTTF shall not be liable for any inaccuracy, error or delay or omission of any data, information or message, or the transmission or delivery of any such data, information or message; or any loss or damage arising from or occasioned by any such inaccuracy, error, delay or omission, non-performance or interruption in any such data, information or message. MTTF does not warrant any liability in the event of the interception, “hacking” or other unauthorized access to information provided by the user of this service. MTTF, further, shall not be liable for any failure of user making payment to protect properly from others, processor in respect of any omission to provide accurate information in the Course of usage of site. We may remove the service for indefinite periods of time or cancel the service at any time, without any notice to you. The service delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied. Under no circumstances shall MathTech Thinking Foundation, its directors, officers, employees, affiliates, agents, contractors, service providers or licensors, be liable for any direct, indirect, incidental, special or consequential damages, or any other damages, costs and expenses whatsoever, including punitive or exemplary losses/ damages/ costs and expenses, lost profits, lost revenue, lost savings, loss of data, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service, or for any other claim related in any way to your use of the service arising out of or in any way connected with the provision of or any inadequacy or deficiency in the provision of services or resulting from unauthorized access or alteration of transmissions of data or arising from suspension or termination of the service without limitation or, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content, transmitted, even if advised of their possibility. Our liability shall be limited to the extent permitted by law, in case, any state or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions.

Indemnification- You agree to indemnify, defend and hold harmless MathTech Thinking Foundation and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors and employees from any claim, demand, liability or damage, law suits, penalties imposed by any State or Central Government Department or statutory body or by a third party including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
15. Amendment – MTTF reserves the right to make amendment/ additions/ deletions/ alteration in these Terms and Conditions or any content related to the site from time to time at its sole discretion and without any notice. MTTF reserves its right to withdraw the service at any time at its discretion without notice.
16. Severability – In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
17. Entirety – The failure of us to exercise or enforce any right or provision of these Terms / Terms and Conditions/ Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to the service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or simultaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against any quarter.
18. Reservation of rights – MTTF reserves the right to;
a) correct any errors, inaccuracies or omissions which may be occurred occasionally for any reason whatsoever to change or update information at any time without notice
b) update, change/ alter or replace, add, delete any part of these Terms and conditions at any time without notice.
c) decline to accept online payment, if account of user is in default for any reason.
d) withdraw the service, partly or wholly, at any time without notice.
19. Resolution of dispute – The user agrees that any disputes on payment will be settled by the online payment system and the MTTF’s responsibility is limited to provision of information only. Record of the instructions given and transaction with the MTTF shall be conclusive proof and binding for all the purposes of resolution of any matter of dispute. However, in the event of failure to settle the dispute, the matter will be resolved by the Arbitrator appointed by MTTF under Arbitration and Conciliation Act, 1996 and rules framed there under as amended up to date. The venue of Arbitration shall be at Bathinda or Fazilka (Punjab).
20. Termination – That, in case of our sole findings you fail or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice.
21. Interpretation – Words denoting the singular number include the plural number and vice versa, words denoting the masculine gender include the feminine gender and words denoting persons include company (ies) / firm(s) and any other entity. Headings are inserted for convenience only and shall not affect the construction of any agreement.
